Prosecutors still intend to pursue domestic violence charges against Nick Diaz after a grand jury declined to indict the UFC fighter.
Diaz was arrested in May and charged with domestic battery and felony domestic battery by strangulation. He was released from the Clark County Detention Center on an $18,000 bond.
Diaz’s attorney, Ross Goodman, argued Tuesday in Las Vegas court that the case should be dismissed and took issue with the district attorney’s office’s move to not follow the grand jury’s ruling.
“We’re telling those grand jurors, ‘We don’t really care what you decide,'” Goodman said, according to the Las Vegas Review Journal.
A preliminary hearing is scheduled for Aug. 30, at which point Justice of the Peace Amy Chelini will rule whether there is sufficient evidence to go to trial.
Diaz (26-9) hasn’t fought since January 2015. He was suspended for one year by the United States Anti-Doping Agency (USADA) for missing multiple drug tests, but he was reinstated as an eligible fighter last month.
